MAILWIZ TERMS OF SERVICE AND PRIVACY POLICY

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE MAILWIZ SERVICE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE MAILWIZ SERVICE.

 

Introduction

The MailWiz service (the "Service") is a subscription-based Software-as-a-Service product that uses artificial intelligence to automatically generate draft responses to emails that users receive. These Terms of Service ("Terms") govern your access to and use of the Service and all content, services, and products available at or through the Service (the "Content").

 

Eligibility

The Service is not intended for use by individuals under the age of 18. By accessing or using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

 

Account Registration

In order to access and use the Service, you must register for an account. You must provide accurate and complete information when registering for an account, and you are responsible for updating your account information to keep it accurate and complete. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify MailWiz immediately of any unauthorized use of your account.

 

Subscription and Payment

The Service is offered on a subscription basis, with fees charged on a monthly or annual basis. The fees for the Service are outlined in the pricing information available on the MailWiz website. All fees are payable in advance and are non-refundable. MailWiz reserves the right to change the fees for the Service at any time, with reasonable notice provided to you.

Data use

MailWiz's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Notwithstanding anything else in this Privacy Policy, if you provide the App access to the following types of your Google data, the App's use of that data will be subject to these additional restrictions:

  • The App will only use access to read, write, modify, or control Gmail message bodies (including attachments), metadata, headers, and settings to provide an email draft writing assistant and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.

  • The App will not use this Gmail data for serving advertisements.

  • The App will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the App's internal operations, and even then only when the data have been aggregated and anonymized.


Intellectual Property

The Content and the Service, including all intellectual property rights therein, are the property of MailWiz or its licensors. You may not use the Content or the Service for any purpose not expressly permitted by these Terms.


Disclaimer of Warranties

The Service and the Content are provided on an "as is" and "as available" basis. MailWiz makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. MailWiz does not warrant that the Service will be uninterrupted or error-free, and MailWiz will not be liable for any interruptions or errors.

 

Limitation of Liability

MailWiz will not be liable for any damages of any kind arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

 

Termination

MailWiz may terminate or suspend your access to the Service at any time, without notice, for any reason or no reason. Upon termination, you lose the right to access the Service.

 

Governing Law

These Terms and your use of the Service will be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.

 

Miscellaneous

These Terms constitute the entire agreement between you and MailWiz with respect to the Service. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect. The failure of MailWiz to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. You may not assign or transfer these Terms or your rights or obligations hereunder, in whole or in part, without the prior written consent of MailWiz. MailWiz may assign these Terms, in whole or in part, at any time without notice to you.

 

Changes to the Terms of Service

MailWiz reserves the right to update and change these Terms from time to time, with or without notice to you. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to regularly check the MailWiz website for updates to these Terms.
